本科毕业设计-试论我国网络虚拟财产的民法保护

AbstractVirtual property has been recognized and reported by civil law. But it is because the lack of legislation, disputes about virtual property are lack of protections without specific legal basis in practice. Regardless of the legal basis of protection from civil law or from the need of reality , it is imperative to establish the civil law on the protection of virtual property. This article takes this problem as the research object and conducts the research and the exploration about virtual property's concept ， attribute and protection in the foundation of other all theory achievements.．Key words：Virtual Property；The Nature Of Virtual Property；Civil Law Protection 试论我国网络虚拟财产的民法保护公民的财产既包括有形的，也包括无形的，越来越多的人认为网络虚拟财产应属于无形财产的一种。虚拟财产应当作为个人的财产进行保护已成为玩家们的共同期待，也逐渐成为进展趋势。但是由于我国目前法律对“虚拟财产”的定性并没有一个明确的规定。没有专门的法律来保护虚拟财产，虚拟财产的价值法律是不认可的。一方面是法律保护的不健全，另一方面，这些虚拟财产，由于具有一定的使用价值和交换价值，能根据不同比例转换成现实中的货币等财产，常常被公开或私下买卖，并引来网络“窃贼”关注。有关网络虚拟财产失窃的案件接二连三发生。民法的功能就在于确定权利的归属和维护交易的安全。其目的在于保护主体合理的、正当的利益。对合法的利益，应当予以权利的保护。网络虚拟财产是主体花了大量时间、金钱、精力所取得的，对主体具有积极的意义，是主体的利益，当然应该视为权利，民法应当承认这种财产利益，并保护这种财产利益。虚拟财产已不是一个虚拟的问题了，而是一个迫切需要法律解决的现实问题。一、 网络虚拟财产的界定和法律属性近年来，网络虚拟财产方面的纠纷不断，法律界也引发了热烈的讨论，但对网络虚拟财产的界定及其法律属性仍然众说纷纭、莫衷一是。（一）网络虚拟财产的界定从现阶段的讨论来看，主要存在广义虚拟财产说和狭义虚拟财产说两种主要观点：广义虚拟财产说认为一切在虚拟空间内的、数字化的、非物化的财产都被认为是虚拟财产，如电子邮箱、QQ...
