AbstractThe presumption of innocence originated in western countries. It has become an international criminal justice and has been widely used in the world. In our country, the presumption of innocence rules is the argumentative focus in law all the time. The spirit of the presumption of innocence was embodied in Criminal Procedure Law of China in 1996, but its rule has not been established completely in our country. There are still some defects in legislation and judicial practice. Therefore, the research about the rule of the presumption of innocence is still significant in theory. This thesis attempts to analyze the current situation and the lack of the presumption of innocence in our country, and explore the necessity of establishing the presumption of innocence in our country, as well as put forward some relevant prescriptive suggestions to perfect the Criminal Procedure Law of China, so that the presumption of innocence can be set up and human rights can be better protected in our country.Key words: The presumption of innocence rule ； The right to remain silent； The exclusion rules of illegal evidence试论无罪推定原则在我国的确立无罪推定原则目前已进展成为国际公约所确认的刑事司法准则，世界上许多国家都规定了无罪推定原则，它们对无罪推定原则的表述方式多种多样，但其都围绕着保障公民权利这个核心。随着西方各种法学思潮的涌入，无罪推定原则进入了我国法学讨论领域。1996 年修改后的《中华人民共和国刑事诉讼法》（以下简称《刑事诉讼法》）第 12 条：“未经人民法院依法判决，对任何人都不得确定有罪。”让我国学者看到了无罪推定原则在我国确立的希望，但对该条的理解学界至今仍存在争议。在我国，无罪推定原则理念尚未深化人心，且立法不足。由于我国立法的不完善以及立法与司法实践严重的脱节，因此笔者认为仍需要对无罪推定原则更多的关注和讨论。为了加强刑事诉讼中的人权保障，推动刑事司法民主化、法治化的进程，我国有必...
