公益信托发展模式探析摘 要：益信托是委托人为了社会公益目的而设立的信托，其目的必须有利于全社会或者社会中的部分公众，是市场经济发达国家为了提升社会福利、发展公益事业而创造性地建立的一项财产分配制度和财产管理制度。在英美法上公益信托又称慈善信托（Charitable Trust），在救济、教育、医疗、卫生等社会公益事业方面发挥了重要作用。本文试图通过解析目前我国公益信托的发展现状，探索我国开展公益信托的模式。关键词：公益信托；现状；发展模式Abstract: public trust is the principal to social commonweal purpose and the establishment of the trust, the aim must be to the society or the public, market economy is developed in order to improve the development of social welfare, welfare and creatively established a property of the distribution system and the property management system. In common law, charitable trust and charitable trust ( Charitable Trust ), in relief, education, medical, health and other social public welfare undertakings plays an important role in. This paper attempts to analyse the current situation of the development of charitable trust in China, explores our country to carry out charitable trust model.Key words: public trust in the current development mode一、益信托概况公益信托，即指为救济贫困、发展文教科卫、环保、慈善等社会公益事业而设立的信托。公益信托主要分三种类型：一是公众信托——委托人为一定范围内的公众的利益而设立的信托；二是公共机构信托——为促进公共机构的管理发展而设立的信托，可以提高公共机构的运行效率三是慈善性剩余信托——由捐款人设立的一种慈善信托，捐款人可将一部分信托收益用于自己及家庭的生活，剩余部分转给慈善机构。相比其他传统形态的公益事业组织，公益信托具有非常突出的优点，这得益于信托财产权的独特架构——受托人拥有信托资金的管理运用权却无法享有财产，受益人享有收益却无法触及资金本金。这种架构使得公益信托在存续期间具有得天独厚的优势：（一）公益信托，有利于保护公益基金的资产不受损失或不被非法挪用；（二）公益信托，由专家理财，能确保基金的安全；（...
