论裁判文书说理不足的现状、原因与对策——以家事裁判文书为视角摘要：判决理由作为判决书的灵魂，一份说理性强的判决书不仅有利于当事人的自觉执行，还可以获得社会公众的认同从而保障司法权威。然而我国目前的司法实际中，家事领域的裁判文书在说理性方面还有欠缺，说理论证的逻辑上也存在诸多问题。本文以家事裁判文书为视角，在研究国内外裁判文书说理的基础上，深入分析我国国内家事领域的裁判文书存在的问题及其背后的原因，并提出针对性的改善文书说理性的对策。关键词：家事纠纷；判决书；说理不足Abstract: The reason for judgment is the soul of the judgment. A statement that is rational and strong is not only beneficial to the conscious implementation of the parties, but also can be recognized by the public and thus guarantee the judicial authority. However, in China's current judicial practice, the judgment documents in the field of family affairs are still lacking in rationality, and there are also many problems in the logic of theoretical evidence.
