论国际环境损害赔偿责任 [摘 要] 随着我国生态文明战略的推进和环境保护意识的加强，跨国环境损害赔偿责任成为环境保护法律制度的重要内容。从墨西哥湾漏油案件、日本核泄漏案件、我国渤海湾溢油案件进行分析，国际环境损害赔偿责任应由污染者、有关国家和相关保险人承担，但应根据承担责任的主次不同和实际情况区别对待。国际环境损害赔偿责任的归责原则由早期的严格责任原则向多元化的过错责任原则发展。我国的环境损害赔偿责任制度存在归责原则不统一、赔偿范围狭窄、免责事由规定不统一和索赔时限过短，应该在归责原则、赔偿范围、免责事由和索赔时限等方面加以完善。[关键词] 国际环境损害；赔偿责任； [Abstract] With the strengthening of China's ecological civilization and strategy to promote awareness of environmental protection, cross-border environmental damage liability becomes the important content of the legal system of environmental protection.
