论唐代的婚姻法律制度[摘 要]唐代是中国历史上最辉煌的朝代。政治、经济、文化都达到了前所未有的巅峰状态，法律更是尤其完备，其中婚姻制度最为典型。唐代婚姻制度的立法有一定的原则，特点鲜明，在婚姻成立和婚姻解除两大主要内容上有严格详细的规定。现代法律在完善婚姻制度的过程中可以参照唐代婚姻制度中的优秀制度成果加以借鉴，同时认清唐代婚姻制度服务于封建社会的本质，辨别出唐代婚姻制度中的缺陷并予以摒弃。[关键词] 唐代；婚姻；礼制；法律制度[Abstract] The Tang Dynasty is the greatest dynasty in Chinese history. Its politics, economy and culture had reached an unprecedented state, and the law is especially perfect. Its marriage system is the most typical. The Tang Dynasty had the certain principles and distinctive features in the legislation of marriage system with strict and detailed rules on the two major contents of marriage establishment and dissolution of marriage. Modern law system can learn excellent achievements of the marriage system in Tang Dynasty in order to make process in the marriage system. Moreover, we have to recognize that the fact of the marriage system in Tang Dynasty is in the service of the feudal society. And we have to get rid of these backward parts in the system of marriage in Tang Dynasty .
