论刑法对男性性权利保护的现状及对策[摘要]传统观点认为，性侵一般只能由男性对女性实施，且行为方式往往仅限于自然性交。但随着时代的发展，出现了不少男性性侵男性、女性性侵男性的案件，方式也多种多样。对于此类案件，受害人往往求救无门，引发了一系列社会问题。刑法修正案九对强制猥亵、侮辱妇女罪的修改一方面加强了对男性性权利的保护，一方面也暴露出一些弊端。我国刑法有必要立足本国国情，借鉴域外先进立法经验，进一步完善相关刑法制度，更好的保障人权和维护社会稳定。 [关键词] 刑法；男性性权利；保护；完善 [Abstract] In traditional concepts,it is generally accepted that sexual assault can only be carried out by men on women, and the way is often limited to natural sexual intercourse.But with the development of the times,there are also many sexual assault cases which happened between men or conducted on men by women with various behaviors.In these cases, male victims often become helpless, which causes a series of social problems.The modification about the crime of Indecency and indignity of women in Criminal Law Amendment nine, which is to strengthen the protection of male sexual rights also Indicates a lot of defects.We need to learn the developed experience of the international legislation based on our own actual situation to improve the system of criminal laws protect human rights equally and maintain the social stability.[Keywords] Criminal law; Male sexual rights; Protect; Perfect长久以来，受男权社会传统观念的影响，对于性这一话题，往往认为在性关系中，只能由男性作为主动方、女性作为被动方，也就意味着性侵行为一般只能由男性对女性实施。因此，法律更偏重于保护女性性权利，而忽视男性性权利。然而，随着社会的迅速发展以及性观念的进一步解放，“男性被女性性侵”甚至“男性被同性性侵”等案件经常发生，使得关于男性性权利如何保护、保护力度是否恰当的话题，一度被推上风口浪尖。对于男性被性侵却得不到刑法合理保护的尴尬局面，使得要求法律给以男性性权利同等保护的呼声不绝。...
