ChineseFoodKitchenManagementServiceAgreement签约日期：年月日DateofSignature:TABLEOFCONTENTS第一条、协议期限Article1Termofagreement第二条、乙方人员岗位及人数Article2Postsandnumberofdispatchedemployees第三条、乙方员工工作时间和休息休假Article3Worktimeandofftimeofemployee第四条、管理费结算Article4Themanagementfee第五条、乙方相关管理规定Article5ManagementprovisionsrelevanttoPartyB第六条、结算标准、支付时间及违约责任Article6Settlementcriteria,paymenttimeandliabilityforbreachofcontract第7条、甲方的权利和义务Article7RightsandobligationsofPartyA第8条、协议的变更和解除ModificationandTermination第9条、争议的解决DisputeResolution第10条、其他Miscellaneous甲方（酒店）：PartyA（hotel）乙方：餐饮管理有限公司PartyB:FoodKitchenManagementServiceCo.,Ltd.甲、乙双方经友好协商，根据《中华人民共和国劳动合同法》及相关法律法规规定，签订本协议，并承诺共同遵守。ThroughfriendlynegotiationsandaccordingtotheEmploymentContractLawofthePeople’sRepublicofChinaaswellasrelevantlawsandregulations,PartyAandPartyB(hereinafterreferredtoasbothparties)reachthefollowingagreementandagreetoabidebyitstermsandconditions.第一条、协议期限Article1Termofagreement合同期为年。期限从起至止。合同期满，合作双方应提前一个月以书面形式提出终止合同，否则，该合同自动续延一年。Thetermoftheagreementshallbeyear(s),specificallyfromto.Eitherpartyshallgiveaone-monthwrittenterminationnoticetotheotherpartypriortoexpiryoftheagreement,otherwisetheagreementwillbeautomaticallyrenewedforayear.第二条、乙方人员岗位及人数Article2Postsandnumberofdispatchedemployees甲、乙双方经协商确认,乙方于本协议有效期内向甲方提供中厨管理服务并派遣中厨房工作人员。乙方负责派往甲方人员明细，请见“中厨房岗位编制表”，见附件1。BothpartiesnegotiateandconfirmthatPartyBshallprovidePartyAwiththeChinesefoodkitchenmanagementservicesanddispatchitsChinesefoodkitchenemployeeswithinthetermoftheagreement.SeeAnnex1ArrangementofPostsforChineseFoodKitchenEmployeesforthedetailsaboutsuchemployees.第三条、乙方员工工作时间和休息休假Article3Worktimeandoff-dutyofemployee1.工作时间：乙方员工在甲方工作期间执行不定时工时工作制。实行综合计算工时工作制或不定时工时工作制的，由乙方负责报经劳动行政部门批准，并告知派遣员工。On-dutyarrangement:TheemployeesdispatchedtoPartyAshallfollowtheflexibleworkinghoursystemwithinthecontractedworkingperiod.Nomattereitherthecombinedortheflexibleworkinghoursystemisfollowed,PartyBshallberesponsibleforreportingittotheLaborAdministrativeDepartmentforapprovalandsuchemployeesshallbeinformed.2.休息休假：派遣员工每周休息一天，将依法享受国家规定的法定节假日和用工单位规定的休假待遇。工作满半年之后，派遣员工每年可享有一次七天带薪年假。Off-dutyarrangement:Thedispatchedemployeesareentitledtoenjoyonedayoffonaweeklybasis,andallofficialholidaysandtheoff-dutyscheduledevelopedbyPartyA.Afterworkingforhalfayear,theemployeesareentitledtoenjoya7-daypaidleaveonayearlybasis.第四条、管理费结算标准方案Article4Themanagementfeeshallbesettledaccordingtothefollowingscheme甲、乙双方约定合同期，乙方共派遣人，甲方每月支付乙方管理费为人民币元；BothpartiesagreethatPartyBshalldispatchatotalofemployeesandPartyAshallpayPartyBRMBasmanagementfeeonamonthlybasisduringtheagreedperiod.甲方每月日前将本协议约定的管理费用交付乙方，乙方开具正式管理费发票。PartyAshallpaytheagreedmanagementfeetoPartyBpriortothethdayofeachmonthandPartyBshallissueaformalinvoiceforit.如有甲方延期个工作日后未支付本合同约定的款...
