论非婚同居关系终止时的财产分割【摘要】非婚同居是指无配偶的男女双方在不违反法律禁止性规定的前提下，不进行结婚登记而持续公开共同生活，形成经济、感情和性等多方面的生活共同体。我国对此现象以及此现象引起的问题一直持回避态度，至今未制定调整非婚同居关系的法律规范。立法上的缺失使得司法实践中非婚同居案件往往存在着同案不同判的现象，尤其是在非婚同居关系终止时财产分割问题上更为明显。基于此种意义，本文试图通过研究国外相关法律规制和中外学者提出的纠纷解决方案，并结合我国现状，找到解决的途径,以期帮助司法实践中的纠纷得到解决。【关键词】非婚同居；共有财产；财产认定；财产分割Abstract：Unmarried cohabitation means that both men and women without spouses continue to live together openly without marriage registration without violating the prohibitive provisions of the law,forming a multifaceted life community of economy, emotion and sex.China has always avoided to face to this phenomenon and the problems caused by it,and up to now, no legal regulation has been formulated to regulate the relationship of unmarried cohabitation.Lack of legislation often leads to the phenomenon of different judgments in the same unmarried cohabitation cases in judicial practice,especially when the non-marital cohabitation relationship terminates, the problem of property division becomes more obvious.Based on this significance, this paper attempts to study the relevant foreign laws and regulations and dispute resolution proposed by Chinese and foreign scholars,and combining with the present situation of China to find a way to solve this problem,finally help the judicial practice of disputes to be resolved.Keywords：Unmarried cohabitation；Common property；Property cognizance；Property segmentation 一、非婚同居的构成要件非婚同居是区别于夫妻同居、姘居等概念的一种男女在一段时间或者长时间的共同生活，在此期间，双方虽然没有婚姻关系，但是经济、感情、生活和性行为等都...
