交通大学毕业设计(论文)摘要索赔就是作为经济合同中合法的所有者权利申请或要求他认为自己应该得到的资格、权益或付款,也就是索赔,土木工程项目承包合同,是业主和承包商双方权利和义务对等的和约。当事人任何一方既享受合同所给予的权利,又必须履行合同所要求的责任和义务。这样合同才能如期完成,双方才能享受各自的的权利。一旦任何一方造成损失,违约方必须根据法律和合同的规定给对方以补偿,这是很正常和合理合法的情况,并非是对任何一方的不友好或处罚行为,只是对实际损失或额外费用的一种补偿,施工索赔和反索赔是业主和承包商在工程项目施工过程中正常的业务往来,它的健康开展,对于培育和进展建设市场,促进建筑业的进展,起着非常重要的作用,因此,对于费用索赔必须要正确对待。本文首先对合同的进展以与对索赔的相关知识进行简单叙述,索赔主要由索赔项目种类、索赔报告等讨论索赔的原则,以工程进度、工程成本和具体索赔事件来分析索赔的机会。依据国际通用 FIDIC 合同条件概括说明索赔程序与方法和索赔分类以与承包商向业主索赔因素,最后从反索赔的概念、种类以与主要形式充分说明业主向承包商的反索赔,还有费用索赔处理的基本原则,能够让搞索赔与合同管理人员充分了解索赔的相关知识,对于索赔有一个理论性的正确认识,并且将索赔方法与工程实践相结合,使其具有有用性和可操作性。关键词:索赔反索赔合同业主交通大学毕业设计(论文)AbstractAs an economic contract is claim legitimate rights for the owners or he thinks he shouldget qualifications, rights or payment, is also claims.
