法学院行政法上“公共利益”的界定

）摘 要公共利益一直是理论和实践研究中的热点和难题。随着中国城市化进程的不断加快，国家法律法规对公共利益的范围和内容认识不明确，程序制定不完善，救济渠道不畅通，补偿机制不科学的问题逐渐凸显。尽管各级行政机关滥用行政权力、违反法律程序的现象逐渐减少，公共利益泛化或者伪造的现象有所好转。但在法治社会不断深入发展的今天，为了更好地建设社会主义和谐社会，仍需对公共利益的相关问题进行细致深入研究，准确把握公共利益的定义、分析吸收域外公共利益界定先进经验、制定符合我国国情的完善措施。 关键词：公共利益；行政体系；行政机关I）AbstractPublic interest has always been a hot topic and a difficult problem in theory and practice. With the rapid development of urbanization in China, the problems such as unclear understanding of the scope and content of public interest, imperfect procedure, unblocked relief channel and unscientific compensation mechanism are becoming more and more obvious. While abuses of administrative power and violations of legal procedures at all levels of the executive branch have gradually decreased, the phenomenon of generalization or falsification of public interest has improved.
