内容摘要夫妻债务制度的研究在立法和司法实践中都有着重要的意义。在夫妻债务制度中，准确的界定夫妻共同债务和夫妻一方个人债务的范围既关乎夫妻双方经济利益，也关乎债权人的财产利益，决定着婚姻家庭法在调整婚姻家庭关系方面是否能起到应有的作用。夫妻债务包括两大部分，夫妻共同债务与夫妻一方个人债务。现实生活中，夫妻债务纠纷的情形十分复杂，但最终可归结为夫妻债务关系中夫妻共同债务与个人债务的区分、认定以及偿还问题。本文对夫妻债务的类型及认定都做了详细的阐述，在研究我国债务制度的立法现状以及清偿原则的基础上，提出了完善相关法律规定的建议。最高人民法院颁布的《关于适用<中华人民共和国婚姻法>若干问题解释（二）》第 24 条把夫妻共同债务的认定标准由“目的论”改为“名义论”，由于欠缺立法基础，背离了婚姻家事立法的基本法理，严重侵害了夫妻另一方的财产权益，亟需完善。本文通过对夫妻共同债务的论述，在借鉴域外相关立法的基础上，建议将夫妻共同债务推定规则限定在日常生活领域，并通过完善家事代理制度，构建夫妻财产补偿等措施，保护夫妻另一方的合法权益。[关键词] 夫妻债务 债务清偿 夫妻债务制度AbstractThe study of the system of the husband and wife debt in legislation and judicial practice is of great significance.
