欧盟合同之债法律适用制度的新发展 ——关于《合同之债法律适用条例》评析李凤琴摘要： 欧盟《合同之债法律适用罗马公约》（以下称《罗马公约》）于 2008 年转换为共同体的立法——《合同之债法律适用条例》（以下称《罗马条例 I》）。《罗马条例I》并不是简单照搬《罗马公约》的规定，而是对《罗马公约》的一些条款作了重新解释或重大修订，这些修订包括：当事人意思自治的调整；当事人未选择法律时合同冲突规则的修订；增加运输合同和保险合同冲突条款；重新界定强制规则以及加强弱势方当事人利益的保护等。《罗马条例 I》可以为我国涉外合同之债法律适用立法提供借鉴。关键词： 欧盟； 合同之债； 法律适用； 条例An Update on the Law Applicable to Contractual Obligation in EU—Comments on EU Regulation on the Law Applicable to Contractual ObligationsLi FengqinEast China University of Political Science and Law , Shanghai, 200042[Abstract]:The Rome Convention on the Law Applicable to Contractual Obligations (Rome Convention) has been converted into a Community instrument in 2008: Regulation(EC) No 593/2008 of the Council on the Law Applicable to Contractual Obligations (Rome I) . Rome I is by no means a verbatim copy of Rome Convention, indeed, the wording of several articles has been rephrased or clarified, and a number of important changes have been implemented. These changes include, inter alia: an adjustment to the principle of party autonomy; a revision of the choice of law rules regarding the applicable law in the absence of choice; new provisions on transports of carriage and insurance; a rephrasing of the so-called “mandatory rules” of law and Strengthening the rights protection of weaker party.
