交通肇事逃逸行为的定性研究学位论文

Abstract In recent years,all kinds of vehicles and drivers growth quickly, traffic accident is rising year by year, traffic escapes issues are becoming increasingly prominent.This not only to the judicial system brings profound effect, also give us to solve traffic escapes case raises new challenges. At present, our country to traffic escapes behavior that has many controversy.This paper through to foreign and Taiwan of China's criminal legislation experience comparative study and using for reference, combined with national conditions, then proposed amendments to the criminal law article 133 stripes and additional traffic escapes sin suggestion. Objectively examine traffic escapes behavior, revise and perfect our country criminal law, for traffic escapes behavior of the conviction will has the extremely vital significance．Key words：Traffic escapes behavior； Traffic accident crime； Traffic escapes crime交通肇事逃逸行为的定性讨论随着社会主义市场经济的进展，各种车辆和驾驶员数量猛增，随之而来的交通事故逐年上升，交通肇事逃逸问题也日益突出。我国现行《刑法》与 2000 年 11 月最高人民法院《关于审理交通肇事刑事案件具体应用法律若干问题的解释》（下称《解释》）以及相关的法律法规的出台，虽然给司法部门提供了处理交通肇事逃逸行为的理论和实践依据，但目前在司法实践中对交通肇事逃逸行为定性还存在一定争议。客观地审视交通肇事逃逸行为，修订和完善我国刑事法律，对交通肇事逃逸行为的定罪量刑将具有非常重要的意义。 一、交通肇事逃逸行为定性讨论的意义常言说：“车祸猛于虎”。肇事者为躲避法律责任而逃逸，一方面给被害人及社会造成不可弥补的损失，另一方面为司法机关正确认定和处理此类案件设置了障碍、浪费了国家司法资源。这类案件不仅扰乱了公共交通安全秩序而且严重危害了人民的生命健康安全和财产安全，是目前我国公共交通安全中函待解决的首要问题。（一）保障人民生命健康和财产安全的需要交通事故发生后，抢救被害人接受事故处理是肇事者应尽的法定义务，但也有某些肇事者未能履行此种义务...
