AbstractJustifiable defense is an important Chinese legal system, criminal law,its purpose is to encourage citizens and the ongoing fight against unlawful infringement,to safeguard public interests and legitimate rights of citizens from the ongoing criminal violation.Experts in criminal law,justice professionals have many problems on defense there are serious differences on the same case with totally different point of view,this case,the ordinary citizen it How can I expect to use this system to protect yourself?Defense provisions in the Penal Code is to encourage active citizenship and the fight against criminals,but the defense in the legislation is too general.Theory is too vague,in practice necessary to the operability greatly reduced.Thus,self-defense can make the effective implementation in practice,some theoretical problems of the necessary.In view of this,the paper first analyzes the problems in our defense system,by comparison to other countries,study and learn self-defense,the last defense System in China some suggestions.Key Words ： Justifiable defense ； Unlawful infringement ； Over-defensive；Defend right peculiarly试论正当防卫制度的完善正当防卫是我国刑法的一项重要法律制度，是正当行为的一种，是法律给予公民同违法犯罪行为作斗争的一种重要权利和手段，是法律给予公民在国家、公共利益、本人或他人的人身、财产和其他权利受到不法侵害时可实行的正当行为。但是，出于诸多原因，正当防卫在司法实践中的运用仍有太多的限制，实践中有关正当防卫案件的错判还是一再发生，暴露出许多问题，防卫人在行使防卫权时遇到了种种困惑。因此，完善我国的正当防卫制度，在当下显得非常重要。一、完善正当防卫制度的意义（一）理论意义正当防卫制度源远流长，设立这个制度的初衷就在于给予公民在面临正在进行的不法侵害时，对不法侵害者实施还击，以保护自己的合法权益的权利。正当防卫在刑法中的确立，就是正义战胜非正义这一古典自然法思想在刑事领域中的逻辑展开和经...
