代位继承制度研究分析研究 法学专业VIP专享

摘 要代位继承，是和本位继承相对应的一种继承制度，是法定继承的一种特殊情况，是公民私人财产顺利转移的重要法律依据。本文针对我国代位继承中存在的主要问题:代位继承的性质采用代表权说及产生的缺陷，发生原因种类单一，适用范围过窄，其他与代位继承相关的制度设计不甚合理等四个问题。进而提出完善我国代位继承制度的立法措施。建议在坚持代位继承只适用于法定继承的大前提下，将代位继承的性质改采用固有权说，扩大代位继承的发生原因，扩大代位继承的适用范围，坚持现有代位继承的法律效力的规定，明确代位人继承权受到侵害的救济途径，进一步完善《继承法》中与代位继承相关的其他规定。以适应时代的发展需要，实现公民的私人财产继承权得到足够的保护。关键词：代位继承；法律依据；存在问题；立法完善ABSTRACTSubstation inheritance, which is a kind of inheritance system corresponding to the standard inheritance, is a special case of legal succession and an important legal basis for the smooth transfer of private property of citizens.
