邻避冲突治理模式转换研究分析 工商管理专业

摘 要经济社会的飞速发展推动了城市化进程，进而催生了公民的权利意识、参与意识和维权意识。在城市化过程中，由于人口的激增对公共服务的迫切需求与公共设施带来的负面效应的矛盾，邻避冲突日益成为我国社会治理的一大难题。本文通过文献分析和案例分析的方法总结得出邻避冲突具有公众基于风险性的主观价值选择、风险的成本与收益违背了空间正义和地域范围内的高度动员性的特点，由此分析得出造成邻避冲突的直接原因，而其本质原因是邻避设施的利益分配结构失衡，并由邻避冲突带来的影响分析得出优化治理模式的必要性和迫切性。现阶段邻避冲突治理的途径主要是行政管制决策，这一模式的特征使其不可避免的陷入公共政策合法性认同下降以及政策垄断使公众参与被形式化和边缘化的困境。因此，本文以协商民主理念为基础，引入深度的公民参与决策机制和多重利益补偿和回馈机制，以此构建出民主治理决策模式，实现邻避冲突治理模式的转换，从而规避邻避冲突，变“邻避为“迎臂”。关键词：邻避冲突；邻避设施；邻避情结；行政管制决策；协商民主AbstractThe rapid development of economy and society has promoted the process of urbanization, and then gives birth to citizen's consciousness of right, participation and protection of rights. In the process of urbanization, due to the contradiction between the urgent demand for public services and the negative effects of public facilities brought by the rapid increase of population, the NIMBY between neighborhoods has increasingly become a major problem of social governance in China. Through literature analysis and case analysis, this paper concludes that the NIMBY has the subjective value choice of the public based on the risk, and the cost and benefit of the risk violate the characteristics of spatial justice and high mobilization in the regional scope.
