论地方立法中的听证制度[摘要]我国立法听证制度建立时间比较短，还处于探索阶段。在实施过程中，由于我国对地方听证的价值缺乏高度的认识，并且地方立法听证规则不具规范性，随意性很大，造成了听证陈述人的遴选机制不完善，听证结果不受重视以及听证主体的权利义务不规范等后果。为了保障我国立法的质量，促进立法活动的民主性、科学性，需要不断地完善立法听证。[关键词]地方立法；听证制度；民主科学[Abstract]China's legislative hearing system has established for a short time, but it is still in the exploratory stage. However, in the process of implementation, because of the lack of a high degree of awareness of the value of local hearings, and the local legislative hearing rules are nonstandard and arbitrary, which results the hearing of the selection mechanism is not perfect, the hearing results are not taken seriously and the main rights and obligations of the hearings are not standardized .In order to protect the quality of our legislation, to promote the democratic and scientific of the legislative activities,we need to constantly improve the legislative hearing.[Key words] Local legislation; Hearing system;Democracy and science 听证制度的成立是一个历经数十年，领域逐步拓展、程序逐步完善，总体而言呈现渐进的过程。引进听证会制度始于上个世纪 90年代，既有借鉴西方实践的因素，也符合宪法的基本精神，同时亦是党的工作方法的基本要求。伴随着《中华人民共和国行政处罚法》的制定，听证制度开始引入国内，并通过该法以法律明文规定的方式呈现出来。后来在《中华人民共和国价格法》的推动下，在适用领域上，听证制度得到进一步的拓展。而《中华人民共和国行政许可法》的出现，使得听证制度在许可程序上变得越来越重要。此外，由于《中华人民共和国立法法》的一大创制，听证制度开始进入立法领域，此后听证制度开始发挥在立法领域的作用，作为听取意见的重要途径，在立法上予以确认。一、地方立法听证制度的概述（一）地方立法听证的含义要了解立法听证的内涵，首先需明确何为“听证”。对于“听证”，有广义和狭义之分。广义的听证是国家机关...
