CONTENTSVolumeI-BiddingProceduresandContractConditionsVolumeII-SpecificationsVolumeIII-BillofQuantitiesVolumeIV-DrawingsVOLUMEI–BIDDINGPROCEDURESANDCONTRACTCONDITIONSCONTENTSInstructionstoBiddersConditionsofContractPartI-GeneralConditionsPartII-ConditionsofParticularApplicationTenderandAppendixtoBidFormofTenderSecurityFormofAgreementFormofPerformanceSecurityFormofBankGuaranteeforAdvancePaymentINSTRUCTIONSTOBIDDERSA.General1.ScopeofBid1.1TheWorldHealthOrganization,hereinafter"theEmployer",wishestoreceivebidsfortheconstructionofa400BedHospitalatSuleimaniyehinNorthernIraq,hereinafterreferredtoas"theWorks",1.2ThesuccessfulbidderwillbeexpectedtocompletetheWorkswithintheperiodstatedintheAppendixtoBid.1.3Throughoutthesebiddingdocuments,thetermsbidandtenderandtheirderivatives(bidder/tenderer,bid/tendered,bidding/tendering,etc.)aresynonymous,anddaymeanscalendarday.Singularalsomeansplural.2.Qualification2.1Biddersshall,aspartoftheirbid,submitinaseparatefoldermarked“QualificationoftheBidder,thefollowingdocuments:(a)Awrittenpowerofattorneyauthorizingthesignatoryofthebidtocommitthebidder;(b)Thenameofthecompany,registeredaddress,description,dateestablished,yearsofexperienceascontractor,structureandorganization,detailsofthenumberoftechnical,administrativeandlabourresources,detailsofcontractor’sequipmentandfacilities;(c)Registrationcertificatesandcertificatesofgoodstanding;(d)Statementconfirmingcurrentownership,directorsandauthorizedexecutives;2.2Bidssubmittedbyajointventureoftwoormorefirmsaspartnersshallcomplywiththefollowingrequirements:(a)ThebidshallincludealltheinformationlistedinSub-Clause2.1above;(b)Thebidand,incaseofasuccessfulbid,theAgreement,shallbesignedsoastobelegallybindingonallpartners;(c)Oneofthepartnersshallbenominatedasbeingincharge,andthisauthorizationshallbeevidencedbysubmittingapowerofattorneysignedbylegallyauthorizedsignatoriesofallthepartners;(d)Thepartnerinchargeshallbeauthorizedtoincurliabilitiesandreceiveinstructionsforandonbehalfofanyandallpartnersofthejointventureandtheentireexecutionofthecontract,includingpayment,shallbedoneexclusivelywiththepartnerincharge;(e)Allpartnersofthejointventureshallbeliablejointlyandseverallyfortheexecutionofthecontractinaccordancewiththecontractterms,andastatementtothiseffectshallbeincludedintheauthorizationmentionedunder(c)above,aswellasinthebidandintheAgreement(incaseofasuccessfulbid);and(f)Acopyoftheagreemententeredintobythejointventurepartnersshallbesubmittedwiththebid.3.OneBidper3.1EachbiddershallsubmitonlyonebideitherbyBidderimself,orasapartnerinajointventure.Abidderwhosubmitsorparticipatesinmorethanonebidwillbedisqualified.4.Costof4.1ThebiddershallbearallcostsassociatedwiththeBiddingpreparationandsubmissionofitsbid,andtheEmployerwillinnocaseberesponsibleorliableforthosecosts,regardlessoftheconductoroutcomeofthebiddingprocess.5.SiteVisit5.1ThebidderisadvisedtovisitandexaminetheSiteofWorksanditssurroundingsandobtainforitselfonitsownresponsibilityallinformationthatmaybenecessaryforpreparingthebidandenteringintoacontractforconstructionoftheWorks.ThecostsofvisitingtheSiteshallbeatthebidder'sownexpense.5.2ThebidderandanyofitspersonneloragentswillbegrantedpermissionbytheEmployertoenteruponthesiteforthepurposeofsuchvisit,butonlyupontheexpressconditionthatthebidder,itspersonnel,andagents,willreleaseandindemnifytheEmployeranditspe...
