我国船员工伤保险赔偿法律问题研究摘要：船员是航运中必不可少的关键人物。随着我国航运事业的发展，对船员的需求量逐步增大。由于船员的工作环境比较特殊，当他们遭受工伤事故时无法如陆上劳动者一般快速维护自己的合法权益。这使得传统工伤保险赔偿制度下船员可以适用的法律法规变得十分局限。为应对新时代构建和谐海上劳动关系的挑战，我们国家有必要对工伤保险赔偿制度作进一步地完备，优化船员发展环境。本文在理清了船员工伤损害赔偿的相关概念之后，分析了我国船员工伤保险制度的立法情况，认为我国目前针对船员工伤保险救济尚无单独立法、船员工伤认定的规定比较简陋、法律适用比较杂乱、赔偿待遇不高和缺少精神损害赔偿，因此，建议出台保护船员的特别法、明确法律适用规范，简化船员工伤保险救济渠道和优化海员职业发展环境，增加精神损害赔偿。关键词：船员工伤保险赔偿 立法现状 面临挑战 应对策略A Study on the Legal Problems of Compensation for Crew's Industrial Injury Insurance in ChinaAbstract:Crews are essential key people in shipping.
