摘 要从古至今，房屋都是人们安身立命的根本，在人们的生活中不可或缺。对大部分家庭来说，房产是他们这辈子最大宗的财产，是夫妻关系物质基础的重要保障。近年来，经济社会的不断发展以及人们的婚姻观念的不断变化，使结婚不可避免的与买房联系了起来，而随着房价的持续走高，适龄青年在结婚时购买婚房，往往要举全家之力，这就进一步凸显了房产的重要程度。同时，随着离婚率的升高、离婚纠纷的增加，夫妻财产分割往往成为婚姻当事人争议的焦点，而房产作为夫妻财产中最重要的一部分，其类型的多样化以及不同当事人实际情况的复杂化也给司法审判增加了不小的难度。 2011 年《最高人民法院关于适用<中华人民共和国婚姻法>若干问题的解释（三）》的出台，一定程度上为房产分割问题提供了明确的依据，弥补了当前法律的不足，但该司法解释也同样引发了许多专家学者的质疑和社会的广泛讨论，值得我们去分析研究。本文围绕离婚诉讼中的房产分割问题展开论述，梳理了当前房产分割中主要涉及的房产类型以及法律规定的分割方法，并结合现存法律和司法解释，对目前我国在房产分割中存在的问题进行了深入的分析，针对性地提出了自己的完善建议。关键词：离婚诉讼；共同财产；房产分割AbstractIFrom ancient times to now, houses are the foundation of people's life and indispensable in people's life.
