I电子商务合同缔约过失责任问题研究内 容 摘 要随着互联网大数据的发展，电子商务模式已经参透到我们生活的方方面面，我们必然会频繁使用电子商务合同。随着社会法治理念的深入，面对电子商务合同的特殊性以及高风险性，人们也越来越注重自身利益的保护，对电子商务合同的缔约过失责任有了更加全面和细致的认识。目前，我国在电子商务合同方面的相关法律法规并不多，关于缔约过失责任更是少之又少。在电子商务合同的缔约过失责任的处理上也随着网络化的发展存在许多问题。本文从电子商务合同与缔约过失的概念特点着手，界定电子商务合同缔约过失责任的范围，并指出法律不够完善、当事人违背诚实信用原则导致缔约过失、当事人使用虚拟身份进行网络缔约和通讯故障等问题导致缔约过失等的问题，并提出相应完善建议。关键词：电子商务合同；缔约过失；法律责任IIResearch on the Fault Liability of Contract Signing of Electronic Commerce ContractAbstractWith the development of big data on the Internet, the e-commerce model has penetrated into all aspects of our lives, and we will inevitably use e-commerce contracts frequently.
