专利侵权之法律责任研究内 容 摘 要随着专利申请数量的增长，专利侵权问题也逐渐显现，我们对专利权的保护也应该要进一步加强。论文通过了解有关专利侵权的理论，对专利侵权行为有一个大致的认识，从而引出法律在专利保护上存在一些不足，有必要对法律责任进行研究；其次探讨了我国的立法现状，提出了在精神损害赔偿方面存在的问题以及加强刑法保护的必要性。在列举其他国家和地区对专利的法律保护情况，了解了其他国家或地区与我国大陆地区在法律上对专利的保护程度不同后，通过对比，可对我国《专利法》和《刑法》给以增加或修改，在民事责任方面完善法定赔偿的适用条件，或者增加精神赔偿的相关立法，在刑事责任方面对假冒专利罪进行分类，或扩大刑法对专利侵权行为的规定范围，两者相结合能进一步完善我国对专利的相关法律保护，为解决当前专利侵权问题提供思路。关键词：专利侵权；法律责任；赔偿IResearch on the Legal Liability of Patent InfringementAbstractWith the increase in the number of patent applications, the problem of patent infringement as gradually emerged, and our protection of patent rights should be further strengthened.
