北京理工大学珠海学院 2020 届本科生毕业论文同人作品著作权法律问题研究摘 要“同人”一词现多指二次创作同人，即原创作品的延伸产物。近几年来，随着国外优秀作品的引入和国产优秀作品的诞生，我国的 ACGN 文化产业得到了快速发展，各种同人作品、同人周边也像雨后春笋一般涌现出来①。与此同时，由于同人作品数量庞大，难以做到完全监管，加上部分人的知识产权意识相对淡泊，导致著作权领域出现了很多新问题，其中最常见的是擦边抄袭还有未经授权使用他人创作的 IP 为自己获取利益等等。本选题意在联系实际分析当前国内同人作品所处的法律境况以及通过分析得出个人对同人作品与著作权保护这方面的相关结论。关键词：二次创作；著作权；侵权因素；权利的保护①ACGN 为英文 Animation（动画）、Comic（漫画）、Game（游戏）、Novel（小说）的合并缩写，是从 ACG 扩展而来的新词汇，主要流行于华语文化圈。由于传统的 ACG 划定的范围早已不足以覆盖现代青少年文化娱乐相关领域，因此衍生出添加了轻小说等文学作品的 ACGN 这个词汇。北京理工大学珠海学院 2020 届本科生毕业论文Study on Doujin Works’CopyrightsAbstractThe term "Doujin" refers to the derivative works, that is, the extension of original works.
