我国教育法制建设的回顾与反思 【英文标题】Reviewing and Introspection on Chinese Education LegalSystem Construction since the Third Plenary Meeting of theCPCs EleventhXIAO【内容提要】摘要：总结十一届三中全会以来我国教育法制建设取得的成绩和主要经验，分析教育法制建设中存在的问题。认为教育法制建设必须以观念更新为前提；与解决当时面临的突出问题紧密相联；总结本国经验与吸收、借鉴国外经验相结合；加强教育立法与注重教育法的实施齐头并进。【英文摘要】The thesis sums up the achievement and experience as wellas issues on Chinese education legal system construction since the Third Plenary Meeting of the CPCs authoradvances,the education legal system construction must updateidea as precondition,must couplet tightly issue then and there,must combine summing-up the old sod experience and absorbingextemal experience,must bring into effect between law-makingand enforcement of law at the same time.【关 键 词】教育/法制/回顾/反思words/education/legal system/review/introspection【 正 文 】一、我国教育法制建设取得的主要成就教育立法从无到有，基本结束了教育领域无法可依的局面自 1978 年以来，党和国家非常重视我国教育法制建设。全国人大及其常委会先后制定和颁布了《学位条例》、《义务教育法》、《老师法》、《教育法》、《职业教育法》、《高等教育法》等教育法规。与此同时，国务院发布或批准了 17 项教育行政法规和法规性文件；地方各省市区人大也相继制定了 138 项地方性的教育法规；国家教育行政部门也颁布了覆盖教育各方面工作的有关教育规章 200 余项；地方各省、市、区人民政府也制定了符合当地教育进展需要的地方性教育规章。教育法律法规，从无到有，并初步形成了以《中华人民共和国教育法》为核心的教育法律法规体系框架，基本结束了教育工作“无法可依”的局面。不断法律规范教育行政执法行为，依法行政观念逐步形成1998 年 7 月国务院下发了《教育部职能配置内设机构和人员编制规定》，对教育部的职权作了明确规定。地方各级政府根据《地方人大和政府组织法》，进一步法律规范地方各级教育行政部门的职权。行政职权法定化，对于教育行政机关依法行使权力，公正、...
