探析平行进口关系的复合法律调整 摘要：平行进口因产品跨越一国国界原来属于国际贸易理论中的基本问题，但知识经济条件下产品所蕴含的巨大无形价值，使平行进口问题在知识产权法中也占据了重要地位。然而对平行进口的知识产权法律约束只是平行进口法律关系的一个方面，市场竞争公平性的内在要求决定了对平行进口尚需从另外一个视角进行规制——这就是竞争法的规制，由此构成了知识产权法与竞争法对平行进口关系的复合法律调整。关键词： 平行进口；知识产权法规制；竞争法规制 Abstract: With the products crossing the territory of a country, the parallel import is one of the basic theoretic issues in international trade. As the products contain numerous invisible values in the knowledge-based economic era, the parallel import has taken up an important position in intellectual property law. However the intrinsic demand for fairness of competitive market requires not only the regulation on intellectual property legal but also the regulation on competitive legal, namely the Anti-unfair Competition Law and Anti-monopoly Law. That is the dual legal regulations on the parallel import. Key words: parallel import; regulation on intellectual property legal; regulation on competitive legal 平行进口涉及三重关系，一是涉外产品销售合同关系；二是知识产权关系；三是竞争关系。对于平行进口的知识产权解释与讨论如火如荼，但其他两层关系的重要性却被人们忽略和淡化了。假如将平行进口作为一个过程看待，平行进口的知识产权关系仅是平行进口过程的一个环节，是控制产品过境的“关卡”。准确认识和把握平行进口法律关系，还应当关注产品入“关”后的关系，即与本国同类产品的竞争关系。 一、 单一维度下知识产权法对平行进口的调整 任何一门法学学科总能体现出理论比法律法律规范丰富、实践比理论更丰富的特点。理论往往是沟通丰富实践和抽象法律规范的桥梁。近年来，知识产权法上平行进口理论获得空前繁荣和进展，其理论建构的基础已经从传统的贸易合同中对 “有形物” 客体的补偿转向对产品上附着的“无形物”价值的保护，主要涉及对私权的影响的评价。由于知识产权法的...
