中 文 摘 要行 政 复 议 作 为 一 部 介 于 行 政 职 能 部 门 与 行 政相 对 人 之 间 的 法 律 ， 调 整 的 是 日 益 膨 胀 的 行 政权 与 行 政 相 对 人 合 法 权 益 是 否 受 到 行 政 权 侵 害之 间 的 法 律 关 系 。 可 见 ， 一 旦 合 法 权 益 受 到 违法 不 当 的 行 政 行 为 的 侵 害 ， 行 政 相 对 人 可 以 通过 行 政 复 议 作 出 维 护 。 但 是 ， 在 目 前 的 行 政 复议 制 度 中 ， 行 政 复 议 机 关 相 对 独 立 性 不 足 已 成为 了 行 政 复 议 制 度 中 一 大 不 可 忽 视 的 问 题 。 在现 实 中 ， 行 政 复 议 机 关 不 但 难 以 在 中 立 、 客 观公 正 的 立 场 上 维 护 相 对 人 的 权 益 ， 也 使 行 政 复议 结 果 的 权 威 性 蒙 上 了 一 层 被 质 疑 的 阴 影 。 本文 希 望 通 过 对 行 政 复 议 机 关 相 对 独 立 性 的 不 足及 其 缺 陷 进 行 分 析 ， 提 出 加 强 其 相 对 独 立 性 的必 要 性 ， 并 在 借 鉴 国 外 行 政 复 议 机 关 独 立 法 律地 位 的 基 础 上 提 出 加 强 我 国 行 政 复 议 机 关 相 对独 立 性 的 构 想 。关 键 词 ： 行 政 复 议 ； 行 政 复 议 机 关 ； 相 对 独立 性 ； 不 足 ； 加 强AbstractOpens with the administrative reconsideration law, administrative reconsideration mentioned in order to prevent and correct illegal or inappropriate specific administrative ACTS, protect citizens, legal persons and other organizations, safeguard the lawful rights and interests of the administrative organs shall exercise supervision and authority.
