AbstractGuardianship system is a very important system of modern civil law,It is the legal system of supervision and protecttion to maintain persons property and other legitimate rights and interests of no civil behavior and limiting the civil capacity person.The purpose of monitoring is to protect the legitimate rights and interests of the absence of a civil capacity,as well as limiting the civil capacity person,to maintain normal social and economic order.China’s guardianship system start late,and due to legislative restrictions on the level of awareness,legislation on the guardianship system developed rougher,general ， the provisions of guardians relevant content is unclear,the monitoring objects scope is narrowness and judicial practice resulted in a lack of maneuverability.In the new socio-economic conditions,we are facing many new problems. This paper is perfect from our guardianship system,with the goal,we study by the value of guardianship system and the comparative study with other country.We focus on the legislation defects and shortcomings of our country’s guardianship syatem,and the perfection of the guardianship legislative recommendations.Keyword: guardian；guardianship object；guardianship oversight body浅论我国监护制度的完善一、完善我国监护制度的意义现代意义上的监护制度是在资产阶级革命后，世界各国为适应生产关系、社会结构等因素的更新，以罗马法中的监护为基础摒弃家长制建立起来的传统监护制度，随着社会经济、文化的进展及社会观念的变化，现代监护制度也在逐渐演变和完善。罗马法上的监护保护的对象是家族财产利益和继承人的利益，即监护人的利益，因而更多的体现出权利性的特点。现代监护制度监护的对象是无民事行为能力人和限制民事行为能力人，与罗马时期的监护相比较，其职责不再是保护家族利益和监护人的利益，而是被监护人的利益，并且更多的体现出义务性。由于新情况的出现，如人口老龄化、残障人士增多等，许多国...
