本科毕业设计-浅论我国隐私权的立法保护

AbstractAs an important personality ,The right to Privacy has been protected by legislation and justice in great major countries .The protection to privacy right by our country begin in the early 1980s in 20th century and has obvious progress in recent years，but it not to be as an independent personality right in general civil law .This status causes the judicial practice at loose ends .Civil privacy right couldn’t receive comprehensive and effective protection .This article analyses to the request to legislation ,further point out the importance and necessity in establishing privacy right in our country .At the same time ,on the basis of the status of current Privacy protection and shortage in China .Writer refer to the foreign legislation achievement about privacy right to raise personal suggestion and opinion that how to strength and consummate the protection of law to Chinese citizens’ privacy right.Key words：privacy；privacy right；personality right；right浅论我国隐私权的立法保护隐私权作为一种法律概念及权利，是美国法的产物。1890 年，美国的两位著名法学家沃伦和布兰戴斯在《哈佛法律评论》发表了著名的《隐私权》（ The Right to Privacy）一文，从此，隐私权在大多数国家逐步确立了自己的法律地位。然而，迄今为止，隐私权仍是一个没有得到清楚界定的法律概念。我国学者则分别对隐私权的概念作出了许多不同的表述。台湾地区的学者王泽鉴先生认为，隐私权是个人不受干扰、隐私不受侵害的权利。 ①大陆地区的学者的代表观点主要有：其一，张新宝认为，隐私权是指自然人享有的私人生活安宁与私人信息秘密依法受到保护，不被他人非法侵扰、知悉、搜集、利用和公开的一种人格权。 ②其二，张莉认为，隐私权是个人为保护人性尊严而对自己私人领域事务的自我决定权。③其三，王利明认为，隐私权是自然人享有的对其个人的、与公共利益无关的个人信息、私人活动和私有领域进行支配的一种人格权。④上述观点均从各自不同的角度就隐私权的概念作了界定，比较而言，鉴于隐私权系一种独立的...
