In this paper, our characterization of the Samaritan acts of the problems, and with special reference to the Samaritan acts of foreign advanced qualitative approach, the Samaritan act of civil law a detailed discussion of qualitative and put forward their viewsKey words: Samaritan；Civil qualitative；not for management见义勇为行为的民法定性近年来，因见义勇为的行为引发的案件日益增多。见义勇为行为是道德高尚之举，但见义勇为者在勇斗歹徒、救灾助人时，保护了他人的利益，自己受到损害时，却无法得到保障，甚至出现见义勇为者与被救人诉诸法院，对簿公堂之事。立法上的空白却使这一类的案件往往面临着无法定性的尴尬境地。由于见义勇为者的行为得不到法律上的有效保护，导致这一优良传统面临着空前的挑战，我国迫切需要健全和完善有关见义勇为行为方面的法律法规。从法律角度鼓舞人们发扬见义勇为的优良传统，使见义勇为行为人能够得到及时、有效的保护与奖励。使见义勇为这一优良风气继续得到和谐的进展，从一定程度上保护人们生命和财产安全，切实减少人民的利益损失。一、讨论见义勇为行为的民法定性的意义见义勇为行为，在我国古代就是人们追求的道德标准。见义勇为作为我国特有的优良传统，被传承和进展到现代化的今日，有其独特的魅力和非同一般的意义。见义勇为的民法定性，应把见义勇为做为一种主体，把见义勇为行为纳入民法的范畴内，结合中国的国情进行相关的分析定位。 ①如此，才能在见义勇为的相关讨论中取得话语权。随着多元化生活的进展，市场经济利益的驱使导致人们的思维观念、价值理念也在发生着转变。在现实生活中，见义勇为者用自己的人身安全作为依托，进行救助。但对见义勇为者而言，救助的付出没有得到保障。更有甚者，...
