本科毕业设计-试论我国弱势群体权利的宪法保障

AbstractThe problem of vulnerable groups becomes one of the key issues that affect the social stability and sustainable development, with market economy development and the rapid transformation of the social structure. To protect the rights of vulnerable groups, the government should rely on legislation first, in particular, on the constitution. In this paper the author explains the requisite of constitutional guarantee of the vulnerable groups’rights, analyses the main problems that exists in the constitutional guarantee, learns and analyses relevant successful experience of the constitution to protect vulnerable groups abroad and finally presents some suggestions to improve the constitution that guarantees the rights of vulnerable groups.Key words ： Vulnerable Groups ； Protect Right ； Constitutional Insurance 试论我国弱势群体权利的宪法保障我国宪法特别注重对公民基本权利的保障。然而，在现实中，许多弱势者因为各种原因受到各种卑视，基本权利不能得到有效保障，甚至陷入生存的困境。传统意义上的弱势群体，是指那些受社会和自身因素制约，靠自身的力量无法保证其个人与家庭的生活，权利容易被侵犯，需要国家和社会予以救助的群体。讨论我国弱势群体权利的宪法保障，具有为弱势群体的权利保障提供根本法上的依据，体现宪法至上与依法治国理念的深切意义。一、我国弱势群体权利宪法保障的必要性（一）宪法保障弱势群体权利是实现平等权的需要形式上的平等，又称绝对的平等，不顾“人”的种种差别，无视个人的自然事实或者能力的差异，一律均等对待，这种平等的结果可能会出现“强者恒强，弱者恒弱”的情况，可能促使社会整体的两极分化，加剧人们之间的不平等，“在平等的名义下，实现的反而是不平等、非正义、不公平。”①因此，弱势群体需要差别对待。从内在价值看，弱势群体权利宪法保障是对法律形式公平性固有缺陷的一种必要补充、修正和超越，体现了对法律实质公平的价值追求。在坚持形式公平原则的前提下，辅之以“不同情况不同对待”原则，对特别人群实行特别权利保护，惟其如此，才能实现完整意义上的平等目标。在我国目前的社会主...
