本科毕业设计-试论我国死刑制度的完善

中文摘要随着现代社会文明的进步，死刑作为一种古老的刑罚制度的成为国内外的关注的焦点。死刑不但失去了其以往在刑罚中的核心地位，而且限制、减少死刑乃至废除死刑已成为世界的潮流和趋势。但从目前我国具体国情、传统观念、经济、司法状况等因素来看，现阶段要彻底废除死刑制度是不可行的，但是为了适应国内外形势的进展要求，不断完善和改革现行的死刑制度对我国限制和废除死刑是十分必要的。本文首先指出我国现行死刑制度存在的各种弊端，从贯彻我国历来“慎杀少杀”的立法主张出发，对我国死刑政策的几个方面做出有实践意义的建言，使我国的死刑政策更加的合理化和人性化。关键词：死刑制度；死刑复核程序；死刑适用限制；死缓制度AbstractWith the progress of modern social civilization,The argument about the death penalty that as a penalty for the old system arouse domestic and international concern.
