AbstractAs China has become an economic power, and strive to become the rule of law against the backdrop of great power, a large number of death penalty cases of dispute the existence of the dispute, not only seriously affected the improvement of our legal system, the speed, but also threatens social stability, while China's temporarily with the complete abolition of the death penalty conditions, but with the progress of society, abolition of the death penalty is only a matter of time. China's current death penalty is to uphold the principle of less killing, and to prevent victimizes. Strictly limit the death penalty, an important system, reflects the basic idea of the death penalty be used with caution. However, the existing criminal law in the legislative, judicial, and enforcement there are still quite a number of problems, this paper aims to discuss the restrictions on China's current death penalty system, the problems, drawing on foreign capital punishment system to limit the technical and experience, resulting in legislative, judicial, law enforcement improve China's death penalty, restrictions on the system.Key Words：The death penalty；Legislation；Limit 试论我国的死刑限制制度的完善随着现代文明社会对人权的关注和保护，限制、废除死刑已成为国际社会刑法改革的趋势。但从我国的社会历史状况来看，我国目前还不适宜废除死刑。因此，严格限制死刑的适用，努力减少死刑的判决和执行，是完善我国死刑限制制度的当务之急。一、完善我国死刑限制制度的重要性（一）死刑的适用不能有效杜绝犯罪首先，刑罚的目的在于预防犯罪，其中包括一般预防和特别预防，从一般预防角度来看，死刑要达到一般预防的目的，就必须对可能发生的犯罪产生威吓作用，即行为人在犯罪前明知自己的行为是犯罪且必定会被判处死刑为前提，但现实中，很多人在实施犯罪时并不知道自己会被判处刑罚甚至死刑。从特别预防的角度来看，特别预防的目的在于预防犯罪行为人的再次...
