本科毕业设计-试论我国民事诉讼答辩失权制度

AbstractEstablishing the survey of defense invalidation can help maintain the litigation justice, improve the litigation efficiency, stable the litigation relationship and prevent litigation assault. The survey of defense invalidation has not been build yet, and the defense system exist some problems in practice and legislation in our country. The survey of defense invalidation is reasonable through analyzing the survey of foreign defense invalidation. In order to build the survey of defense invalidation, legislative and judicial advice is proposed through analyzing the value of defense invalidity and some defense system problems and referencing the survey of foreign defense invalidation. Key words: Defense；The Survey Of Defense Invalidation ；Litigation System试论建立我国民事诉讼答辩失权制度随着民事审判方式改革的不断深化与拓展，法学理论界与实务界已逐渐认识到：民事审判方式改革重心应转为审前准备程序改革。“审前准备程序是民事诉讼中的庭审活动乃至整个诉讼活动得以顺利进行的必备前提，是保证庭审质量和提高庭审效率的有效基础，对于法院审判权的有效行使、当事人诉讼权利的充分行使和当时人权益的切实维护具有重要意义。”①而作为审前准备程序之一的答辩环节，假如能够法律规范、有效地运用，对于 人民法院查清事实，分清是非，正确适用法律，及时解决纠纷等具有重要意义。然而在实践中，被告可能基于内心的损害、没有充分答辩时间、策略性的考虑等因素，从而导致被告在法定的期限内拒绝答辩，或者作出立场模糊的答辩等。特别是被告对原告的观点突然袭击而导致原告败诉的情况屡屡出现，这不仅有碍于司法的公正，甚至降低了诉讼的效率，从而破坏了司法秩序。对于被告的答辩，在我国，由于法律文化、法律思想和追求客观事实价值观的影响，往往受到较少的关注。而且答辩环节的不法律规范，也直接影响庭前准备程序作用的有效发挥，甚至影响整个诉讼程序公平与效率。再加上，我国民事诉讼举证时限及证据失效制度也已确立，而与之相配套的答辩保障制度尚未建立，以致原被告双方争论点在庭审准备阶段尚不明确，证据提供与证明无法进行，审前进行的证据交...
