本科毕业设计-试论我国缔约过失责任制度的完善

AbstractFault liability system is an important law modernization logo. Our country contract law in refers to foreign fault liability system based on the prevailing practice, from our reality, first to misfeasance carried on a more complete and further improved the provisions of Chinese contract responsibility system, realized with the interests of the contracting parties, which reflects the utterance of contract law protection value concerns. But in judicial practice, about fault liability system still existed some shortage, need further modified and perfected, this paper firstly proposes the establishment fault liability system in China, points out the necessity of fault liability system in legislation the existing problems. According to these disadvantages, to improve our fault liability system in the specific measures should be taken, thus make debt law system of a civil liability system to be more perfect, more effective to protect the lawful rights and interests of the contracting people in China, to maintain the order of the market economy.
