中 文 摘 要随 着 互 联 网 的 日 趋 普 及 ， 虚 拟 财 产 的 数 量 和价 值 急 剧 增 加 ， 虚 拟 财 产 引 发 的 纠 纷 同 样 也 以惊 人 的 数 量 大 幅 度 的 增 长 。 但 对 于 这 类 案 件 ，我 国 刑 事 立 法 尚 属 于 真 空 区 域 ， 司 法 机 关 无 法可 依 ， 打 击 不 力 。 本 文 通 过 对 我 国 台 湾 、 香 港及 国 外 的 相 关 立 法 及 司 法 实 践 的 对 比 讨 论 与 借鉴 ， 提 出 完 善 我 国 虚 拟 财 产 刑 法 保 护 的 建 议 ：对 虚 拟 财 产 的 法 律 属 性 予 以 界 定 ， 明 确 其 受 刑法 的 保 护 ， 增 设 “ 侵 犯 虚 拟 财 产 罪 ” ， 以 保 障我 国 网 络 产 业 的 健 康 持 续 进 展 与 社 会 稳 定 。关 键 词 ： 虚 拟 财 产 ； 网 络 产 业 ； 财 产 属 性 ；侵 犯 虚 拟 财 产 罪AbstractWith the growing popularity of the Internet, the number and value of virtual property increased dramatically, disputes about virtual property also are an alarming increase in the number. However, Chinenes criminal legislation hasn't relevant provisions of these cases, the judiciary is no legal basis and combating ineffective.
