摘 要目前国内建筑市场还很不法律规范，长期计划经济影响，工程建设参加主体在施工过程中面临着许多不确定性因素和风险。建筑市场受买方市场的经济规律支配，合同双方承担的风险是不均等。受到来自建筑市场各种主体本身和客观条件的阻碍，导致施工费用索赔工作存在一系列问题。这些问题严重影响企业的经济效益，制约了企业的生存和进展。本文结合我国施工合同文本、施工索赔有关法律依据、从承包商的角度出发，主要对费用索赔的概念、分类和费用索赔的作用进行系统的论述。工程费用索赔的计算方法也是重要内容之一，是索赔的基本数据。然后根据工程建设参加主体存在的问题、费用索赔风险防范问题、监理的权力及处理费用索赔难点、承包商面临工程索赔机制的困境、费用索赔证据的资料管理、费用索赔计价依据存在问题和费用索赔计价方法、解决费用索赔争议的方法。最后结合案例，进行索赔费用的计算分析，并总结出索赔过程中的几点体会，为工程费用索赔提供实践参考。关键词：建筑工程；费用索赔；案例分析AbstractThe domestic construction market is still not standardized, long-term planned economy; the work involved in the main building during the construction faces many uncertainties and risks.
