论收养中的几点问题及对策 [摘 要] 我国的收养立法中存在一些问题，如被收养人的范围太小、收养人的条件太苛刻、收养类型单一、国家干预不到位和未区分无效和可撤销收养等。因此，有必要借鉴欧美国家的有益经验，提出相应的解决方案以完善我国的收养立法。如适当放宽收养人和被收养人的范围、增设不完全收养制度、强化公权力介入和完善收养无效和撤销制度，以保障儿童的正当权益。[关键词] 收养;问题;对策[Abstract] There are some problems in the Adoption Legislation of our country,such as the scope of the adoptee is too small, the conditions of the adopter are too harsh, the type of adoption is single , state intervention is not in place, and does not distinguish between void adoption and revocable adoption, etc.Therefore, it is necessary to learn from the experience of the European and American countries， and Put forward the corresponding solutions to improve the Adoption Legislation of our country. As appropriate to relax the range of adopter and adoptee, adding the incomplete adoption system, strengthening the public power intervention and improving the void and revocable adoption system, to guarantee the legitimate rights and interests of children.[Key words] adoption ; problem ; solution收养作为保护儿童权益的重要方式，在当代社会中发挥了不可取代的作用。同时，随着老龄化社会带来的种种问题，旧的社会保障体系将难以支撑，而收养对于解决老年人赡养问题也不失为一条较好的解决途径。因此，为有效发挥收养的社会功能，需要从我国的收养立法出发，深入探究我国收养立法存在的问题，以完善我国的收养制度。一、收养概述(一)收养的概念 收养是指公民依法领养他人子女为自己子女，从而使收养人与被收养人建立拟制亲子关系的民事法律行为。 [1]领养他人子女的人是收养人，将子女或儿童送给他人收养的父母、其他监护人和社会福利机构是送养人，被他人收养的人是被收养人。收养人、送养人和被收养人是收养行为的当事人，但需要说明的是，送养人虽然是收养行为的参加者，但并不是收养关系的主体。收养使得原来没有父母子女关系的人...
