论我国立法程序的完善分析研究 法学管理专业

论我国立法程序的完善[摘 要] 立法程序具备合法性、公开性、自律性的优良品性，但由于受我国传统法律观念中重视实体法律、忽视程序法律的影响,虽然我国现行立法程序已迅速发展，但其中的优良品性没有得到足够重视。虽然立法实体方面得到重点关注，但在一定程度上却忽视了对立法程序方面的研究。就当前而言，我国在立法程序上存在如法律案的起草机制存在不足、审议程序不合理、制定立法规划的主体缺乏主导性、立法监督体制缺乏独立性等诸多问题，阻碍了立法程序的进一步的发展。因此，通过对我国立法程序所存在的问题进行分析，从立法体系、立法规划、立法监督体制这三个方面提出合理的解决对策与方案，从而完善我国立法程序。[关键词] 立法程序；问题；原因；完善[Abstract] The legislative procedure with legitimacy, openness, autonomy of the good qualities, but because of the heavy entity, light procedure by the Chinese traditional legal idea, although the development of China's current legislative process has been rapid, but good conduct which do not get enough attention, the academic circles focus on the substantive legislation to a certain extent, ignored the study of legislative procedures. Whether it is to analyze from the theoretical or practical point of view, our country still exist such as the legislative process: problems of drafting mechanism of legal case, narrow approval is not standardized, the main legislative rules of legislative supervision and lack of legal provisions etc..
