论正当程序理念的解析与培养[摘要]正当程序作为贯穿法律体系的一项重要理念，在法律体系中起着至关重要的作用。正当程序发展历史由来已久，在中国已经形成相当的研究体系。然而受到我国传统法律文化、社会人文等因素的影响，正当程序理念发展虽然如火如荼，但在某些方面还是有所欠缺，在法律制定、实施以及法治教育过程中均存在着对正当程序理念的忽视，阻碍了法治进程。因此要重视正当程序理念在法律制定实施及法治教育中的养成，加大对正当程序理念的培养，共同促进社会发展。[关键词]正当程序；理念；解析；培养[Abstract]Due process as an important concept of the legal system,plays a vital role in the legal system.The development of due process has a long history ,and aconsiderable research system has been formed in China.However,affected by the traditional legal culture and social cultural factors in our country,although the development of due process concept is like a raging fire,but in some areas is still lacking, in the process of law making ,implementation and the rule of law education,there is a neglect of the doctrine of due process, impede the rule of law process.Therefore we should attach importance to the formation of the doctrine of due process in the formulation and implementation of law and the rule of law education,and increase the development of the concept of due process, jointly promote social development.[Keywords]Dueprocess; Concept ; Analysis ; Development正当程序是法治建设的一个重要的环节，贯穿社会生活的方方面面。然而在现实生活中，由于我国对程序法的重视远不如实体法，“重实体、轻程序”的思想观念还影响着人们。正是因为对正当程序重视不足，以至于在具体法律实践中对正当程序理念的普及还要加强。一、正当程序的概述（一）正当程序的内涵正当程序在法理学上是一个相对独立的理论，它既可以是一种比较抽象的观念，又可以体现为明确的法律条文。正当程序起源于英国的“自然正义”，它是英美法系中一条重要的法治理念和宪法原则，源于 1215 年的英国《自由大宪章》。正当程序又称正当法...
