完善我国慈善捐助法律制度的几点思考陈 颖 （法学，03 法本 2，03024222）指导老师：方益权摘 要：近年来，我国慈善捐助事业进展较快，相关法律法规也有出台。但与发达国家相比，法律法律规范仍不够完善，特别是存在公民慈善意识淡薄、慈善捐助主体缺位、捐助对象分散、监管不到位、现有相关法律法规原则性过强等问题。本文从分析慈善捐助的概念出发，分析了我国慈善捐助存在的问题，并结合国外相关的理论成果和实践经验，提出了完善我国慈善捐助法律制度的意见：（1）引导、激发公民的慈善意识；（2）明确慈善组织独立法人地位；（3）制定《慈善捐助事业法》及配套法规和实施细则，为慈善事业的进展制造良好的法制环境；（4）完善慈善捐助的监管机制。关键字：慈善捐助；慈善意识；慈善组织；监管机制Abstract：In recent years, the enterprise of charitable donates develop quickly in our country, and the related laws and regulations have appeared.
