论文题目： 同性恋婚姻立法研究 摘 要同性婚姻是基于同性成员之间的婚姻。而同性婚姻立法就是关于同性婚姻的立法。虽然同性婚姻立法在我国还没有被广泛关注，但是关于同性婚姻立法所代表的同性恋者的婚姻的权利始终为人们所重视。此外对同性婚姻立法所要考虑的关于同性恋者这一社会弱势群体的权利保障也是人们对法律平等观念的提高。目前我国关于婚姻的定义虽不包括同性婚姻，但从婚姻法立法修改进程来看，我国的婚姻法并不对同性婚姻有所排斥。尽管现在还存在反对同性婚姻立法的观点，但这些观点都在一定程度上代表了婚姻强势群体的观点而忽略了作为弱势群体的同性恋者本身对婚姻权利的追求。因此，本通通过以上论述，来阐明我国同性婚姻立法已经具备一定的应然性和可行性。[关键词]：同性婚姻；权利保障；应然性；可行性 AbstractSame-sex marriage is based on between members of the same sex marriage. While same-sex marriage is about same-sex marriage legislation. Although same-sex marriage legislation in our country has not been widely concerned, but about same-sex marriage legislation represents the gay marriage rights always paid attention to by people. In addition to the same-sex marriage legislation should consider about homosexuals the social vulnerable groups' rights protection is of legal equality ideas to improve. At present our country about the definition of marriage does not include same-sex marriage, but the marriage law amendment process of view, marriage law of our country does not have the exclusion of same-sex marriage. Although there is still opposed to same-sex marriage legislation point of view, but these views are represented to some extent by marriage strong groups view and ignore as vulnerable groups of gay marriage rights to pursue.
