隐私权保护视角下的个人征信法律规制[摘 要] 个人征信具有维护社会经济秩序、保障经济平稳发展的重要功能，能有效促进个人信用信息的交流，进而有效解决现代信用经济中存在的信息不平衡而产生的弊端。隐私权是宪法赋予公民的一项基本权利。基于隐私权保护视角下探讨个人征信的法律规制意义重大。通过分析国际上三种个人征信法律规制模式的异同，吸取其成功经验。在此基础上对完善我国个人征信机构监管机制提出合理建议，寻求适合本国国情的个人征信模式，加大个人征信中隐私权的保护力度。[关键词] 个人征信；隐私权；法律规制[Abstract]Personal credit checking has the important function of maintaining social economic order and ensuring stable economic development. it can effectively promote the exchange of personal credit information, and effectively solve the problems of information imbalance in modern credit economy. The right to privacy is a fundamental right granted to citizens by the constitution. It is of great significance to discuss the legal regulation of personal credit checking based on the perspective of privacy protection. By analyzing the similarities and differences of the three kinds of international personal credit reference laws and regulations, draw their successful experience. On this basis, we put forward reasonable suggestions to improve the regulatory mechanism of individual credit bureaus in China, and seek personal credit information model suitable for our national conditions, and strengthen the protection of privacy right in personal credit investigation.
