我看我国用益物权体系的构建 [摘 要]用益物权制度是物权法的一个重要组成部分。本文分两部分进行阐述。第一部分对用益物权制度中值得探讨的几个问题进行分析并阐明观点；第二部分对如何构建我国的用益物权体系提出了新的见解。在现阶段，要完善我国立法既要借鉴传统和国外的有益经验，更应该注重中国的现实状况和法律基础。 [关键词]物权法 用益物权 构建 Abstract： The institution of usufructuary right is an important part of the Law of right in Rem. This article is composed of two sections. Section one refers some analyses and opinions about several problems that being worthy of discussion in the institution of usufructuary right. Section two gives new suggestions about how to structure a system of usufructuary right in China. At present， to perfect our legislation， we ought to absorb the good experience from history and overseas， and what‘s more， we also have to attach importance to the reality and the existing foundation of Law in our country. Key Words： the Law of right in Rem， usufructuary right， structure 目前我国物权法立法正处于紧锣密鼓的进行之中，已相继出台的三个物权法草案：社科院《物权法草案建议稿》、人大《物权法草案建议稿》、人大法工委《征求意见稿》以及二次审议稿，各具特色、自成体系，为我国的物权立法工作提供了很好的模本。其中关于用益物权制度的立法引来较多的关注和争议。 20 世纪以来用益物权已进展成现代物权法的重要支柱之一，在物权法中的地位越来越举足轻重。当今我国虽然没有一部统一的物权法，没有系统规定用益物权制度，但在民法、特别法和实际生活中仍然体现了一系列用益物权的存在①。随着社会经济的进展和人们对资源利用需求的增加，仅仅靠这些来调整资源的利用是不够的，需要制定一套健全和完备并具有中国特色的用益物权制度以资适用。 通过对三个物权法草案的分析对比，综合众多学者的观点和意见，我认为一套合理的用益物权体系已初具雏形。但不可否认的是，其中还存在一些尚待商榷的论题。在这里笔者将对于存在争议的几个问题稍作分析，并对用益物权体系的构建提出自己的见解。 一 争议的几个问题...
