我国网络隐私权法律保护制度的完善学位论文

中文摘要随着社会的进步与网络技术的迅速进展，网络隐私面临着前所未有的威胁。因此，确认网络隐私权，完善网络隐私权保护的相关法律制度显得尤为迫切。如何既恰当地保护网络隐私权,又不阻碍网络的正常进展,已经成为各国制定网络隐私权保护的法律法规的重点和难点。目前，我国传统隐私权立法尚未完备，网络隐私权的法律保护在具体操作上实行的措施也不够到位。我们应综合考虑目前的立法状况和网络时代侵犯隐私权的特征,借鉴他国的先进经验并结合我国具体国情,完善我国网络隐私权的法律保护制度,全面保护公民的网络隐私权。关键词：网络隐私；保护；行业自律；立法价值AbstractAlong with social progress and rapid development of network technology, network facing unprecedented threats to privacy. Therefore, make sure Internet privacy, and improve the protection of Internet privacy-related legal system of civil law is particularly urgent. How to properly protect both network privacy, again not interfere with the normal development of the network, have become countries to create network privacy protection laws and regulations of the emphases and difficulties. At present, China's traditional privacy of network privacy legislation hasn't complete, civil protection in the concrete operation measures taken in also not enough in position. We should be taken into account in the current legislation status and characteristics of invasion of privacy in network era, referencing advanced experience and combining with China's specific conditions, perfect our country's network privacy legislation, the comprehensive protection of citizens' network privacy.
