中文摘要尽管我国法律没有明文规定“法官自由裁量权”，但“法官自由裁量权”在司法实践中却无处不在。由于我国的立法滞后，法官素养偏低及司法独立没有真正落实等原因，造成实践中产生许多问题，需要进一步完善。在立法上，应以法律形式给予法官自由裁量权明确的授权范围，并富于合理弹性的法律规则，根据社会的需要不断完善法律法规。而在司法实践上，司法机关应注重更新观念，出台符合社会进展形势的司法解释，不断健全司法监督制约机制，对正确运用法官自由裁量权实行鼓舞原则，着力加强法官培训制度，进而提高法官综合素养。关键词：法官自由裁量权；司法公正；规制AbstractAlthough the laws have been not defining the concept of "judges’ discretion" literally in China, it is ubiquitous in the realm of judicial practice. Due to the lag of legislation, the low judges’ quality, and the unrealized judicial independence in China, it results in so many problems in practice that we have to ameliorate these. In the legislation, it is necessary to give the judges’ discretion the scope of authorization clearly in legal form, which has reasonable elastic legal rules, and constantly improve laws and regulations according to the needs of the society.
