AbstractAs the core of the witness institution ， the institution of the testimony by the witness before the court plays a crucial role in improving the effectiveness of the witness’s testimony．And witness at the court stand is of great significance in reforming the traditional court trial ． While in practice ， witness seldom appears in court and refuses to tell ， which influences reformation of trial style in our country．With this mind，the author of this paper tries to probe into this problem ， focusing on criminal cases ． The paper mainly covers the following details：the value of this system study；the current situation and its course；and finally，suggestions concerning the solution to the problem base on the current situation in China and similar practices in other countries.Key words：witness；the testimony of a witness；witness system试论我国证人出庭作证制度的完善证据在诉讼进程中起着不可替代的作用，而证人证言作为证据的重要形式，在诉讼中更是扮演着举足轻重的角色。尤其在刑事诉讼中，证人证言更是公安机关立案侦查、检察机关审查起诉、法院定罪量刑的重要依据。一、证人出庭作证制度的讨论意义证人出庭作证是仔细贯彻以事实为依据，以法律为准绳这一司法原则的重要形式 ，是正确定罪量刑和保护被告人的合法权益的重要手段。证人证言作为直接证据，在揭露案件事实，打击犯罪活动等方面具有十分重要的意义。（一）有利于最大限度地实现审判公正我国刑事诉讼法修改以后，公安机关和检察机关被给予了更大的调查取证职权。一方面，检察机关在起诉时只移送证据目录、证人名单和主要证据复印件或照片即可，可以不向法院移送全部案卷材料和提供所有证据，也不需要在庭审前将其收集的证据向辩护方展示。另一方面，由于控辩双方的要求和侧重点不同，控诉方往往会积极地收集指向被告人的有罪证据，而忽视甚至有意地隐瞒对被告人有利的证据，与此相反，辩护人在调查取证和了解证据材料方面的应有权利并没有得到有效的保障。一方面，从刑事案件的侦查到起诉，辩护人查阅案卷材料的权利受到了很大的限制，很难全面了解...
