关于现阶段灵活就业人员职业损害保障的思考关于现阶段灵活就业人员职业损害保障的思考 【摘要】 2024 年 4 月 ，《国务院关于做好当 前和今后一段时期就业创业工作的意见》 明确提出要“探究适应灵活就业人员 的失业、 工伤保险保障方式， 符合条件的可享受灵活就业、 自 主创业扶持政策”。关注灵活就业人员， 保障其权利义务， 已成为当 今社会保障工作中的一个重要方向。 对可按现有体制纳入工伤保险统筹管理的人员， 通过政府强制、 社会保险保障的办法， 督促用人单位为职工参加工伤保险 ； 对难以界定是否存在劳动关系的灵活就业人员， 通过政府主导、 商业保险运作的模式， 建立起灵活就业人员 职业损害保障。 【关键词】 灵活就业人员 ; 职业损害 ; 社会保障 【中图分类号】 F840.684 C913.7 【文献标识码】 A 【文章编号】 16743830（ 2024） 10624doi:10.19546/j.issn.16743830.2024.10.014Thoughts on Occupational Injury Protection for Flexible Employment Personnel at thePresent Stage Chen Yunzhu, Ni Hong(Jiangsu Department of Human Resources and Social Security, Nanjing,210008) 【Abstract】 In April 2024, the State Council put forward in the document that we should explore ways toadapt to the unemployment insurance system for fl exible employees.
