城市房屋拆迁的行政法思考分析研究 公共管理专业

摘 要近年来，我国城市房屋拆迁遇到的问题越来越多，强制拆迁成为社会矛盾的焦点，政府与人民群众的矛盾愈演愈烈。这些因素出现的原因主要来源于行政法律法规的不完善，政府的权力过大，司法机关容易受到行政的影响，导致监督机制失灵。虽然我国规定了补偿办法，但是没有明确的补偿标准，也没有从法律上确立补偿原则，没有从制度上规定政府应该如何承担补偿责任，将着重从如何解决城市法务拆迁存在的问题方面阐述。关键词：城市房屋拆迁；个人利益；行政法保护；补偿原则AbstractIn recent years more and more problems of the urban housing demolition become the focus of social contractions .The contradiction between the government and the people become worse and worse.The reason of these factors of it is easily lack of the law enforcers of our public security,the gorvernment is too powerful.Judicial organs easily affected by the administrative organ.Although there are rules for compensation method in China, there is no clear compensation standard, no established legally compensation principle,and no rules for how the government should understand the compensation responsibility from the system.
