完善我国隐私权界定问题的探讨学位论文

Abstract Personality of the right to privacy is an important right belonging to the scope of civil rights, theoretical circles generally classified as private rights. For the protection of privacy around the world, research has always attached great importance to many countries, the right to privacy included in the code, directly to be protected. The study of privacy in China is lagging behind, resulting in real-life against the right to privacy are widespread. Defined in the study of privacy in terms of theoretical level or system level, privacy as a fundamental legal rights in modern society has a significant value indisputable. However, due to privacy in our existing laws and regulations are not clearly defined．Not coordinate the relevant legal norms, so in practice throughout the judicial practice, and there is no uniform standard. The author defines the right to privacy by drawing on foreign experience and our right to privacy legislation and judicial practice, exploring the issue shortcomings, improve the privacy of our problem of defining a specific number of ideas put forward.Key words: privacy defined ； important value ； deficiency ；suggestions完善我国隐私权界定问题的探讨隐私权的概念和理论，发端于美国。但在我国现行的法律中至今尚未形成隐私权的法律保护体系。隐私权不具有独立的法律地位，相关的法律法律规范尚不协调，特别是对“隐私权”的概念、权利内容和范围也没有明确的界定，再者隐私权立法方面的漏洞和缺陷还相当多，以致司法实践中出现的各种问题缺乏解决的统一标准，导致各方面矛盾的扩大，这显然不利于我们的社会生活以及公民隐私权的保护，因此借鉴于别国的立法经验，对于建立和完善我国隐私权的保护立法是不无裨益的。一、完善我国隐私权界定问题的重要性隐私权作为公民人格权中的一项重要权利，在现代社会中已经具有无可争辩的重要价值。保护隐私权，是人类文明进步的表现，标志着社会文明程度的提高，一方面有...
